1. Introduction
Welcome to Thunder (the “Platform”). These Terms and Conditions (“Terms”) govern your use of the Platform operated by Thunder Technologies Pty Ltd (“we,” “us,” or “our”). By using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
2. Platform Usage
2.1 User Types
There are two types of users on the Platform: Retailers and Suppliers. Retailers use the Platform to create product listing requirements (“Range Reviews”), and Suppliers use the Platform to submit products for those reviews.
2.2 Eligibility
By using the Platform, you represent and warrant that you are at least 18 years of age, legally capable of entering into a contract, and agree to abide by all applicable local, state, national, and international laws and regulations.
3. Account Registration
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account and password and agree to notify us immediately of any unauthorized access or use.
4. Product Submission and Range Review
4.1 Retailer Responsibilities
Retailers are responsible for specifying product categories, deadlines, and criteria for product submissions. Thunder is not liable for the retailer’s decisions regarding submissions or any loss due to inaccurate criteria.
4.2 Supplier Responsibilities
Suppliers must:
- Submit accurate, truthful, and non-misleading information regarding their products and business.
- Warrant that the products submitted are their own, or they have the necessary permissions to submit them.
Thunder reserves the right to take appropriate action, including removal of submissions or suspension of accounts, if inaccurate or misleading information is discovered.
5. Use of Data
Thunder will handle any personal data provided in accordance with the Privacy Policy. Thunder may also collect and use aggregated, anonymized data from your activity on the Platform for performance improvements and analytics.
6. Intellectual Property
Thunder owns all rights, title, and interest in and to the Platform, including all software, design, trademarks, and any related intellectual property. You agree not to reproduce, distribute, modify, or create derivative works based on the Platform without express written permission.
7. Refund and Dispute Policy
7.1 Refund & Cancellation Policy
All fees paid for the use of the Platform are non-refundable, except as required by applicable law or under our 30-Day Satisfaction Guarantee. If you experience issues with the Platform, please contact us at [email protected], and we will review your concerns on a case-by-case basis.
Thunder offers a 30-Day Satisfaction Guarantee for all paid services. If you are unsatisfied with the Platform within the first 30 days of use, you may request a full refund by contacting [email protected]. This guarantee is limited to the first 30 days from the initial purchase and can only be invoked once per user or organization.
Subscription Cancellation
Users can cancel an ongoing subscription at any time. However, refunds are not available for the current active billing cycle or any remaining term of the plan. The cancellation policy varies based on the selected payment plan:
- Monthly Plans: If you cancel a monthly subscription, the cancellation will take effect at the end of the current month, and you will not be billed for the subsequent month.
- Annual Plans: If you cancel an annual subscription, the cancellation will take effect after the completion of the minimum 12-month term. Refunds are not available for unused months or remaining portions of the annual term.

7.2 Dispute Resolution
If a dispute arises between users of the Platform (e.g., Retailers and Suppliers), Thunder may facilitate communication between the parties but is not obligated to mediate or resolve disputes.
In the event of a dispute involving Thunder directly, you agree to attempt to resolve the issue informally by contacting us at [email protected]. If the dispute cannot be resolved informally, it will be subject to the governing law and jurisdiction outlined in these Terms.
8. Limitation of Liability
Thunder will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform. We provide the Platform on an “as-is” basis and do not make any warranties of any kind, either express or implied.
9. Termination
We reserve the right to terminate or suspend access to the Platform at any time, with or without notice, if we believe you are violating these Terms or are otherwise engaged in unauthorized use of the Platform.
10. Changes to the Terms
We may modify these Terms at any time. When changes are made, we will notify users by updating the Effective Date at the top of these Terms. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of [Insert jurisdiction], without regard to its conflict of law principles.
